Terms of Service

The short version

PazBy is a one-time $2.99 Android app that quietly nudges you when you're near a place you've saved. It runs on your phone — no account, no server we operate, no subscription. By installing and using PazBy, you agree to the terms below. The big things to know: (1) PazBy is a convenience reminder, not a safety-critical or emergency system — don't rely on it for situations where missing a nudge would harm you; (2) the app's location radar is best-effort and can be interrupted by your phone's battery saver, dead battery, lost GPS signal, or the operating system killing background apps; (3) if PazBy breaks something for you, our liability is capped at what you paid (which is $2.99).

1. Who runs PazBy

PazBy is an independently-developed Android app. The developer of record is reachable at developer@pazby.app. Throughout this document, "we", "us", and "our" refer to that developer; "you" and "your" refer to the person using the app.

2. Agreement to these terms

By installing, accessing, or using PazBy on any device, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, do not install or use the app. If you've already installed it, uninstalling it ends your agreement going forward (but doesn't undo anything that's already happened — for example, a purchase already processed by Google Play is still subject to Google Play's refund rules).

3. What PazBy does

PazBy lets you save places (a hardware store, a pharmacy, a friend's house, a viewpoint you've been meaning to visit) and shows you a notification when your device's location indicates you are near one of those places. It is a personal convenience tool. It does not provide navigation, traffic information, turn-by-turn directions, emergency services, or any kind of safety-critical alerting. 4. Your licence to use the app

Subject to your compliance with these terms and your purchase of PazBy through the Google Play Store, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use one copy of the PazBy app on Android devices that you own or control, for your own personal, non-commercial use.

5. What you can't do

You agree that you will not:

  • Copy, modify, distribute, sell, or sublicence the app or any part of it.
  • Reverse-engineer, decompile, or attempt to extract the app's source code, except to the extent expressly permitted by applicable law.
  • Use the app in connection with any unlawful activity, including stalking or harassing another person.
  • Use the app to track another person's location without their informed consent. PazBy is designed to be installed on the user's own device for their own purposes.
  • Use the app for any safety-critical, emergency, medical, navigation, or commercial routing purpose. PazBy is not designed, tested, or certified for any of those uses.
  • Use the app on a device that is not your own, except where you have the device owner's explicit permission and have made them aware of how the app uses location data.
  • Bypass, disable, or interfere with any security, licensing, or technical limitations of the app.

6. Your data and privacy

PazBy stores your saved places and event log on your device. We do not operate a server that receives your personal data. If you opt in to Google Drive backup, an encrypted file is uploaded to your own Drive's hidden AppData folder — we never see it. Crash reports, on release builds, contain stack traces and anonymous device information but no personal data. See the Privacy Policy for the complete picture.

You are responsible for the saved places, reminder text, and other content you create inside the app. Don't put anything in there you wouldn't want stored on your own device or on your own Google Drive.

7. Purchase, billing, and refunds

PazBy is sold as a one-time purchase through the Google Play Store at the price displayed in the store at the time of purchase (presently $2.99 USD or local equivalent). The purchase unlocks all current features for the lifetime of the app on the Google account that bought it. There is no subscription and no recurring charge.

All payments are processed by Google. We do not see or store your payment card details, billing address, or any other financial information. Refund requests are governed by the Google Play refund policy — typically a self-service refund is available within 48 hours of purchase via Google Play. After that, contact Google Play Support; we cannot issue refunds directly because we never receive the funds directly.

We reserve the right to change the price of new purchases at any time. Price changes will never retroactively charge a user who has already bought the app.

8. Important disclaimers — please read

PazBy is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise — including, to the maximum extent permitted by law, any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

The radar is best-effort.

PazBy depends on your device's GPS, Wi-Fi positioning, cellular signal, operating system, available battery, and other factors that are outside our control. Notifications may be delayed, missed entirely, or delivered at a different distance than you set. Possible causes include — but are not limited to — your phone being in battery-saver or low-power mode, the operating system killing background apps, GPS being unavailable indoors or in dense urban areas, network outages, manufacturer-specific battery optimization aggressively suspending the app, the phone being switched off, or simple physics (you walked past the place faster than the radar's polling cadence could react).

Not for safety-critical, emergency, navigation, or commercial use.

Do not use PazBy for any purpose where missing a notification, getting a delayed notification, or receiving an inaccurate location could cause injury, financial loss, harm to property, or any other adverse consequence. This includes — but is not limited to — emergency response, medical reminders where missing a dose has health consequences, fleet tracking, regulated transportation, or any context that legally requires certified location services. Use Google Maps, your phone's emergency dialler, dedicated medical-alert systems, or other purpose-built tools for those use cases.

Maps and place information.

Maps and place data shown in the app come from third-party services (primarily Google Maps and the Android system Geocoder). We don't control the accuracy, currency, or completeness of that data. A place pin shown on the map may not match the actual real-world location of a business or address.

Your saved data.

You are responsible for backing up your saved places. PazBy offers a built-in Drive backup feature you can opt in to, but we make no guarantee that backups will always succeed, always restore cleanly, or never be corrupted. If you lose your device, your saved places, or your encryption passphrase, we cannot recover them.

9. Limitation of liability

To the maximum extent permitted by applicable law:

  • We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, opportunity, or substitute services, arising out of or in connection with your use of (or inability to use) PazBy — even if we have been advised of the possibility of such damages.
  • Our total aggregate liability to you, for any and all claims arising out of or relating to these terms or your use of the app, is capped at the amount you paid us for the app — which, as of these terms, is $2.99.
  • Some jurisdictions do not allow the exclusion of certain warranties or limitations on certain kinds of liability. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted by local law.

10. Indemnification

You agree to indemnify and hold harmless the developer, contributors, and licensors of PazBy from and against any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your misuse of the app, your violation of these terms, or your violation of any third party's rights — including, in particular, using the app to track another person without their consent.

11. Third-party services and links

PazBy uses Google Play Services, Google Maps SDK for Android, Google Play Billing, Google Drive REST API, the Android system Geocoder, and Firebase Crashlytics. Your use of those services is also subject to their respective terms and policies (notably Google's Terms of Service and Google's Privacy Policy). We are not responsible for the conduct of those third parties.

This website and the app may link to other third-party sites we do not control. We are not responsible for the content or practices of those sites.

12. Changes to the app

We may add, modify, or remove features of PazBy at any time, without prior notice, to fix bugs, improve performance, respond to changes in the Android platform, or for any other reason. Material changes that affect how your data is handled will be communicated through the app or via an updated Privacy Policy.

13. Termination

You may stop using PazBy at any time by uninstalling it from your device and (if applicable) revoking its Drive access at myaccount.google.com/permissions.

We may suspend or terminate your right to use the app, with or without notice, if you violate these terms, if continued provision becomes unlawful or technically infeasible, or if we discontinue the app entirely. If we discontinue the app, your local installation will continue to function until your device or operating system stops supporting it.

14. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent change. Material changes will be highlighted in the app or in an in-app notification when reasonably possible. Continued use of the app after a change becomes effective constitutes acceptance of the updated terms. If you do not agree to a change, your remedy is to stop using the app.

15. Governing law and disputes

These terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable in Ontario, without regard to its conflict-of-laws rules. You and we agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario for the resolution of any dispute arising out of or relating to these terms or the app, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

Nothing in these terms restricts your right to bring a claim in a small-claims court or to assert non-waivable consumer-protection rights granted to you by the laws of your country or province of residence.

16. Severability and waiver

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these terms is not a waiver of that right or provision.

17. Entire agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and us regarding the PazBy app, and supersede any prior agreements relating to the same subject matter.
